Firm Successfulyy represents real estate broker in lawsuit from leading condo developer
Alex Kurkin recently represented Beachfront Realty, a real estate brokerage based in Miami Beach, in a lawsuit filed by a nationally known and recognized condominium developer over broker commissions.
With many condominium buyers electing to walk away from sales contracts and relinquish their deposits, the developer sued Beachfront and other real estate brokerages in an effort to force the agents to return commissions on the purchases that were not finalized by buyers. The suit focused on 19 sales contracts in the 389-unit Beach Club Tower III property at 1800 Ocean Drive in Hallandale Beach.
Articles about the lawsuit appeared in The Wall Street Journal and The Miami Herald, which quoted Kurkin explaining that the suit was tenuous because the purchase agreement did not specify that commissions must be refunded if the buyer fails to close.
Kurkin also points out in the articles that the condominium developer was risking alienating the realty firms that bring prospective buyers to its properties, and apparently the developer took heed. Shortly after the articles were published, the company rescinded its lawsuit.
